1) Acceptance of Terms
By inviting or using InfiniTea, you confirm you are authorized to bind the Discord server or organization you represent, are at least 13 years old (and meet any higher age required by your jurisdiction or Discord), and accept these Terms on behalf of yourself and any entity you represent. If you do not agree, do not use the Service.
2) Service Scope & Third-Party Platforms
InfiniTea operates inside Discord. Your use of Discord remains subject to Discord's own terms and policies. We do not control Discord or other third-party services, and outages or policy changes by those providers may affect the Service. We may add, change, or remove features at any time without notice.
3) Accounts, Authorization, and Server Access
- You must ensure anyone granting InfiniTea permissions in your server has proper authorization.
- You remain responsible for configuring roles, permissions, and automations to match your rules and risk appetite.
- If you remove the bot or leave a server, user and server data associated with that server are deleted, except historical payment data retained as required by Delaware law.
4) Acceptable Use
You agree not to misuse the Service. Prohibited behavior includes harassment, hate speech, threats, infringing content, spam, fraud, evasion of Discord policies, exploiting or reverse engineering the Service, interfering with security, or violating applicable law. We may use automated and manual review to detect abuse and may report apparent criminal activity to authorities.
5) Data Practices & Privacy
We do not collect non-public personal data beyond what Discord makes available through its APIs for the functionality you enable. We do not sell or share data with third parties. We encrypt traffic in transit and apply encryption at rest where appropriate. Limited internal tools may scan content for abuse; automated reports may be sent to relevant platforms or authorities when abuse is detected. When a user leaves a Discord server, their data is removed; when the bot is removed, server data is removed except for payment records we must keep. For details, see our Privacy Policy.
6) Payments and Licensing
- InfiniTea is provided as SaaS. Paid plans, if offered, are billed as described at purchase.
- Payment history may be retained to satisfy accounting and legal obligations (including Delaware recordkeeping requirements).
- Refunds, renewals, and cancellations follow the terms shown at checkout; where not specified, fees are non-refundable to the fullest extent permitted by law.
7) Availability and Support
The Service is provided “as available.” Performance may vary due to Discord, network conditions, or maintenance. There is no guarantee of uninterrupted or error-free operation. Support is provided through published channels on a reasonable-effort basis.
8) Security
We use encryption in transit and apply safeguards to protect the Service. You are responsible for securing your Discord accounts, access tokens, roles, and any credentials you control. Promptly notify us through the support channels if you suspect unauthorized access or misuse.
9) Enforcement, Suspension, and Termination
- We may suspend or terminate access for violations of these Terms, suspected abuse, legal requirements, or operational risk.
- You may remove the bot at any time; data related to that server will be removed, subject to payment-record retention described above.
- Provisions that by nature should survive termination (including limits of liability, disclaimers, indemnities, and dispute terms) will survive.
10) Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. USE OF THE SERVICE IS AT YOUR OWN RISK. WE DO NOT WARRANT THAT THE SERVICE WILL MEET REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ABERRATION LABS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100) IF NO PAYMENTS WERE MADE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS; IN SUCH CASES, THE ABOVE APPLIES TO THE FULLEST EXTENT PERMITTED.
12) Indemnification and Hold Harmless
You agree to defend, indemnify, and hold Aberration Labs, Inc. harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or violation of law or third-party rights, except to the extent resulting from our intentional misconduct. You acknowledge we are held harmless for good-faith actions taken to protect the Service or users.
13) Dispute Resolution; No Litigation
- You agree to resolve disputes with us through informal negotiation first. If unresolved, disputes will be resolved by binding arbitration on an individual basis under Delaware law. Court litigation and class actions are waived to the extent permitted by law.
- Claims must be brought within one year of when they arose. Equitable relief for unauthorized use or misuse of the Service may still be sought where allowed by law.
14) Governing Law
These Terms are governed by the laws of the State of Delaware, excluding its conflict of laws rules. The seat of arbitration will be Delaware unless we mutually agree otherwise.
15) Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above and, where reasonable, providing notice through the Service. Continued use after changes become effective constitutes acceptance of the updated Terms.
